Terms of Service

"Service" means the DailyCheck software platform, accessible via web and through WhatsApp Business integration, which allows professionals to send automated questionnaires and monitor responses from their patients, clients or students.

"Customer" means the professional or organization that subscribes to DailyCheck. "User" means any person authorized by the Customer to operate the account. "Patient" means the person monitored by the Customer through the Service.

DailyCheck is intended exclusively for professional (B2B) use: it may only be used by healthcare, wellness, education or similar professionals, for purposes consistent with their professional activity.

The Customer agrees to obtain their Patients' consent before sending them questionnaires via WhatsApp, to use the Service in compliance with applicable law (including GDPR) and WhatsApp Business's terms of use, and not to use the Service for unlawful, harassing purposes or purposes not authorized by the Patient.

The Service is offered on a subscription basis according to the plans described on the Pricing page. All plans include a 14-day free trial, with no credit card required.

The Customer may upgrade or downgrade at any time from the account settings. The subscription may be cancelled at any time, with no minimum commitment and no penalties; cancellation takes effect at the end of the current billing period.

Prices are listed in Euros and may be subject to VAT under applicable law.

The Customer remains the owner of all data entered or generated through use of the Service, including information about their Patients and questionnaire responses. Our processing of that data is governed by the Privacy Policy and the Data Processing Agreement available in the account settings.

The DailyCheck platform, its software, trademark and any other intellectual property remain the exclusive property of Synapses S.r.l. and are not transferred to the Customer by virtue of the subscription.

We strive to keep the Service available and functioning with due professional diligence, but the Service is provided "as-is" with no guarantee of continuous availability, except as otherwise agreed in writing in a service level agreement (SLA) for the Clinic and Enterprise plans.

To the maximum extent permitted by applicable law, our total liability to the Customer for any claim relating to the Service is limited to the amount paid by the Customer in the 12 months preceding the event giving rise to the claim. We are not liable for indirect damages, loss of profits or data resulting from the Customer's improper use of the Service.

The Customer may terminate the subscription at any time from the account settings. We reserve the right to suspend or terminate access to the Service in the event of a breach of these Terms or non-payment, with prior notice where reasonably possible.

These Terms are governed by Italian law. Any dispute regarding their interpretation or performance shall be subject to the exclusive jurisdiction of the Courts of Milan, Italy, except as otherwise provided by mandatory consumer protection rules.

We may update these Terms periodically. In the event of material changes, we will notify Customers with reasonable notice via email or in-app notification.
